Object: Information about the processing of your data, according to art. 13 , D.Lgs. n. 196/2003 “Data Protection Code”

We inform you that in order to satisfy your requests and to supply you with our goods according to the orders you will sign , our organization must obtain and actually retain some of your personal data , collected directly or trough third parties. These data may be qualified as “personal”, on the base of art.4 of D.Lgs. 196/2003, the Italian “Data Protection Code”.
This law requests that the company which treat personal data must inform the “data owner” about the kind of data treated and the specific processing. The processing must be licit and transparent in respect of your rights and your privacy.
For these reasons, we give you the following information according to art. 13 of D.Lgs. 196/2003 :

› Nature of data

We hold and treat data as names, address, fiscal or V.A.T. codes, bank accounts and address, telephone numbers and other data needed to produce, send and invoice our goods and accomplish to the contract with your company or to buy goods and services.
We don’t hold any data which can be qualified as “sensitive” or “judicial” according to the art. 4, c.1 , of the D.Lgs. 196/2003.

In some cases for particular processings may be necessary to have your agreement. In this case we will send you another information and we will ask you to sign it as evidence of your agreement.

› Purpose of the processing

Your data will be treated for contractual reasons and to accomplish to law requests. At the end of the contract, we will archive you data according to the law requests.

› Modalities of the processing

The processing will be accomplished trough instruments which will grant the security and privacy. These instruments include electronic devices and documents included in data base.

› Obligatory or voluntary nature of providing the requested data and consequences in case of fail of reply

Some kind of data are strictly necessary to accomplish to some parts of the contract (see names and address in order to invoice the service or the good), other data are needed because requested by the law for fiscal reasons. In all these cases your agreement is strictly requested in order to proceed with order. In lack of it, we will be unable to grant you with our service or product or to buy your service or products. For all the data which we don’t need to accomplish to the contract, we will evaluate them from time to time, and we will ask you separately for agreement if necessary.
› Communication and dissemination of data

Your data will not be disseminated. By the term “dissemination” we mean to divulgate the data in an uncontrolled form to undetermined parties.
Your data may be communicated to one ore more of the following parties :

• Subjects in charge of the process in our organization;
• Subjects who must be admitted to your data in force of the law;
• Third parties like banks or transporters to whom we must communicate your data ;
• Consultants or lawyers in charge of administration, accountancy or other process, in our behalf and following to our instructions.

› Your rights

According to Art.7 of D.Lgs. 196/2003,

• 1) A data subject shall have the confirmation as to whether or not personal data concerning him exist , regardless of their being already recorded and communication of such data in intelligible form.
• 2) A data subject shall have the right to be informed :
• a. Of the source of the personal data;
• b. Of the purposes and methods of the processing;
• c. Of the logic applied to the processing, if the latter is carried out with the help of the electronic means;
• d. Of the identification data concerning data controller, data processor and the representative designated as per Section 5
• e.Of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data ();
• 3) A data subject shall have the right to obtain
• a. Updating, rectification or, where interested therein, integration of data;
• b. Erasure, anonymization or blocking of data that been processed unlawfully, including data whose retention is unnecessary for the purpose for which they have been collected or subsequently processed ;
• c. Certification to the effect that the operations as per letters a) and b)have been notified (...) to the entities to whom or which the data were communicated unless this requirement proves impossible ();
• 1) A data subject shall have the right to object, in whole or in part,
• a. On legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
• b. To the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
